Restrictions to be placed on applications for Village Greens
The Department for Communities and Local Government (DCLG) is conducting a consultation on proposals to restrict the ability of any interested party to apply for village green protection for land during the currency of any related application for planning permission affecting the land concerned. Applications for village green status would similarly be precluded by other so called “trigger events” such as a local development order, draft neighbourhood development plans and the designation of land for building in a Local Plan.
Under the proposals, the right to apply for village green status will be suspended at the point at which the ‘trigger event’ affecting the land concerned is first publicised, and the exclusion will remain in place until such time as the cause of the suspension is determined; a ‘terminating event’.

DEFRA Consultation
The full list of trigger events is set out in schedule 1A of the Commons Act 2006. Some examples of trigger events include:
The first publication of an application for planning permission for the land, which will include circumstances where planning permission is subsequently granted.
The publication by the local planning authority of a draft local plan or neighbourhood plan proposal which identifies the land for potential development.
The adoption or making by the local planning authority of a local plan or neighbourhood plan which identifies the land for potential development.

Response Form
A proposed application for development consent under the Nationally Significant Infrastructure project regime.

An application under the Nationally Significant Infrastructure project regime which has been accepted by the Secretary of State (in practice the planning inspectorate).
The consultation remains open until 19 August 2013.
